These general terms and conditions apply to every offer made by FunFabrik and to every agreement concluded between FunFabrik and the Customer. We recommend that you read these terms and conditions carefully before placing an order.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

1. Definitions<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

  • FunFabrik :<\/b> The user of these general terms and conditions and supplier of the products\/services.<\/p><\/li>

  • Customer:<\/b> The natural or legal person who enters into an agreement with FunFabrik .<\/p><\/li>

  • Products:<\/b> The animation boxes, materials and \u201cspecials\u201d as described on the website or in the quotation.<\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    2. Applicability<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    These terms and conditions apply to all offers, quotations and agreements between FunFabrik and the Customer. By placing an order, the Customer agrees to these terms and conditions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    3. Delivery and transport<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    Option 1: Full service by FunFabrik <\/b><\/p>

    • FunFabrik brings the products to the agreed location and picks them up again afterwards.<\/p><\/li>

    • The risk of damage or loss during transport lies entirely with FunFabrik .<\/p><\/li>

    • The Customer must ensure an easily accessible loading and unloading area.<\/p><\/li><\/ul>

      Option 2: Shared logistics<\/b><\/p>

      • In this case FunFabrik delivers the products and the Customer returns them, or the Customer collects the products and FunFabrik picks them up.<\/p><\/li>

      • The risk of damage or loss during the transport part carried out by the Customer is entirely at the Customer's expense.<\/p><\/li><\/ul>

        Option 3: Self-service (collection and return)<\/b><\/p>

        • The Customer will collect the products himself at FunFabrik's location and return them at the agreed time.<\/p><\/li>

        • The risk during transport (loading, transport, unloading) is entirely with the Customer from the moment of transfer at FunFabrik's location.<\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

          4. Use and Liability<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
          \n\t\t\t\t
          \n\t\t\t\t\t\t\t\t\t

          • The Customer undertakes to use the rented or supplied materials with \u201cdue diligence\u201d.<\/p><\/li>

          • Damage to the materials (other than normal wear and tear) occurring during the period that the Customer has the materials in its care will be charged in full to the Customer.<\/p><\/li>

          • FunFabrik shall not be liable for indirect damage or injury resulting from the use of the materials supplied.<\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

            5. Reservation, cancellation and amendment<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
            \n\t\t\t\t
            \n\t\t\t\t\t\t\t\t\t

            5.1 Final reservation<\/b><\/p>

            A reservation is only final after successful payment via the website or written confirmation by FunFabrik.<\/p>

            5.2 Cancellation period<\/b><\/p>

            The Customer has the right to cancel a reservation free of charge until 14 days before the agreed reservation date<\/b>. In this case, the rental fee and deposit already paid will be fully refunded within 7 working days.<\/p>

            5.3 Late cancellation<\/b><\/p>

            In case of cancellation within 14 days before the booking date, the Customer will owe the full rental fee (100%) as compensation for the reserved materials and schedule. However, the deposit paid will be fully refunded in this case.<\/p>

            5.4 <\/b>Change of date<\/b><\/p>

            Moving a reservation to another date is considered a cancellation of the original date, unless FunFabrik explicitly agrees in writing to a free change.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

            6. Payment<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
            \n\t\t\t\t
            \n\t\t\t\t\t\t\t\t\t

            • Payment shall be made via the payment methods offered on the webshop, unless otherwise agreed in writing (e.g. on invoice for companies).<\/p><\/li>

            • All prices include VAT unless explicitly stated otherwise.<\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

              7. Force majeure<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

              In the event of force majeure (such as extreme weather conditions), FunFabrik will have the right to suspend delivery or terminate the agreement without compensation.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

              8. Guarantee scheme<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
              \n\t\t\t\t
              \n\t\t\t\t\t\t\t\t\t

              8.1 Payment of the deposit<\/b><\/p>

              With every booking of an entertainment box or \u201cspecial\u201d, the Customer is obliged to pay a deposit. The amount of the deposit is clearly stated with the product in the webshop and must be paid at the same time as the rental fee. The reservation is only final once both the rental fee and the deposit have been received.<\/p>

              8.2 Control on issuance and receipt<\/b><\/p>

              • On departure:<\/b> FunFabrik will ensure that the materials are in good condition. The Customer is expected to check the goods immediately on receipt for visible defects or missing parts and to report this immediately.<\/p><\/li>

              • On return:<\/b> Upon return, the materials will be checked by FunFabrik for damage, completeness and cleanliness.<\/p><\/li><\/ul>

                8.3 Retention of the deposit<\/b><\/p>

                The deposit may be retained (in whole or in part) in the following cases:<\/p>

                • Damage:<\/b> In case of breakage, defects or damage to the box or its contents.<\/p><\/li>

                • Missing:<\/b> When parts or accessories are not included with the return.<\/p><\/li>

                • Cleanliness:<\/b> If the materials are returned abnormally soiled (cleaning costs may be charged for this).<\/p><\/li>

                • Late return:<\/b> If the materials are not returned at the agreed time (see Option 2 and 3 in Article 3).<\/p><\/li><\/ul>

                  8.4 Reimbursement<\/b><\/p>

                  If the materials are returned in good condition, complete and on time, FunFabrik will refund the full deposit within 7 working days of the return date. The refund will be made by the same means as the payment, unless otherwise agreed.<\/p>

                  8.5\u00a0<\/b>Breach of guarantee<\/b><\/p>

                  If the assessed damage or the value of the missing parts exceeds the deposit paid, the Customer shall remain liable for the remaining amount.
